ATLANTA, Ga. (Atlanta News First) — The grandmother of a 2-year-old boy who drowned at a Roswell apartment complex last month has been charged in his death, according to arrest warrants.

Emelisa Paz-Santos was booked Wednesday in the Fulton County Jail on a felony count of 2nd-degree cruelty to children and a misdemeanor count of involuntary manslaughter in the death of her grandson Axel Delgado.

She also has an Immigration and Customs Enforcement (ICE) hold, jail records show.

On the night of June 21, Roswell police responded to The Lake House at Martin’s Landing after reports of a young child drowning at the clubhouse pool.

There, first responders provided aid to 2-year-old Axel Delgado, who died the next day at the hospital.

Investigators determined that Paz-Santos was in charge of supervising Axel while he was at the pool, but “failed to provide adequate supervision” for “an extended period of time,” leading to his death, according to the arrest warrants.
