I want to urge you to support an alternative to restrictions on advertising in the Food and Drug Administration Revitalization Act, Senate Bill 1082, introduced by Senator Kennedy, Dem-Mass.
This bill may be voted on very soon and is being debated in the Senate this week.
We urge you to oppose this bill because it contains the authority for the government to impose a 2-year ban on advertising of new prescription medications.
Can you believe this day and time, the government wants to actually limit the amount of knowledge you have about important new drugs and technology available to you, thru your doctor, of course?
The provisions restricting advertising in the Kennedy bill would violate the First Amendment protection for commercial speech.
There is no evidence that limiting drug advertising will promote drug safety - rather, barring information from advertising will cause more harm to consumers who are not prompted by an ad to see a doctor about an illness. Surveys show that these ads prompted more than 39 million to ask their doctor about a particular health condition.
The most important safeguard is with our physicians - no one can get a drug without a doctor examining us, and writing a prescription.
