According to Georgia code 16-11-38, a person is guilty of a misdemeanor, if he or she wears a mask, hood, or any other device that covers their face and conceals their identity on public property.
That law does not apply to people wearing a holiday costume on a holiday. But Dougherty County Police HEAT Officer Dorian Hall says it is illegal to enter on private property, such as a convenience store, with your identity concealed.
He says even if an innocent customer walked in with a mask, it's enough to spook a clerk to call 911. "I would tell these people that are going to go out on Halloween, if they go to the store, they need to leave the mask in the car. It only takes a second to take it off," said Dorian Hall of DCP.
It is legal to wear a mask on property if the property's owner has given written permission to do so.
