Convicted Grady Co. child killer will stay in prison

ATLANTA, GA (WALB) - The Supreme Court of Georgia has upheld the Grady County felony murder conviction of Michael Angelo Foster in the death his girlfriend's 15-month-old baby boy, in 2002.

Malcom Lewis died of head and stomach trauma. Foster claimed the boy drowned in the tub, but investigators did not find traces of water on the boy or in the tub.

The boy's mother, 21-year-old April Lewis, was not at home at the time.

Foster, who was about 21 at the time of the crime, argues that the evidence at his Grady County trial was insufficient to convict him.

But in today's opinion, the high court disagrees. "The evidence was sufficient to enable a rational trier of fact to find Foster guilty of the crime of which he was convicted beyond a reasonable doubt," Justice Harold Melton writes for a unanimous court.

Foster is serving a life sentence at Wilcox State Prison.
