ATLANTA, GA (WALB) - Under an opinion Friday by the Supreme Court of Georgia, a woman whose son claimed his bank charged exorbitant overdraft fees, in violation of Georgia usury laws, can move forward with class action status.
In a news release issued Friday, the high court said that the justices unanimously over-ruled the Georgia Court of Appeals, allowing Ellen Rambo Bickerstaff, acting for her now-deceased son, may pursue a class action, and represent similar SunTrust Bank customers who were charged overdraft fees for ATM or debit card charges.
The Supreme Court is sending the case back to the Court of Appeals; the first step toward certifying the case as a class action lawsuit.
