LEESBURG, GA (WALB) - Saying it was one of the toughest decisions he ever made, a prosecutor drops charges against an Albany man in the 2013 motorcycle crash death of a well-known fire inspector.
Despite a tear-filled plea for justice from the victim's widow, prosecutors decided not to pursue Misdemeanor vehicular homicide and failure to yield charges against Karis Stubbs.
Stubbs was indicted in the September 2013 death of 56-year Dan Harden.
Investigators say Stubbs turned his car in front of Harden's motorcycle on Pinewood Road.
Chief Assistant District Attorney Lewis Lamb said "While it is a tragedy I can't prove beyond a reasonable doubt that it was a crime. And so I made the decision not to prosecute the case."
Judge George Peagler approved the D.A.'s decision to not pursue prosecution.
