ALAPAHA, GA (WALB) - The Georgia Supreme Court had, as of Monday, upheld the murder conviction and life in prison sentence for Lewis Dyal, of Alapaha.
Dyal was convicted on March 25th, 2009 of shooting his son, Jonathan Wright Dyal, twice in the face on December 17th, 2007 at their home on A. B. Heath Rd. Lewis Dyal, who was 56 at the time of the murder, claimed it was in self defense but during the trial prosecutors argued that he had a history of alcoholism and domestic violence.
The high court did, however, throughout Dyal's conviction and sentence for aggravated assault stemming from the murder. The court stated that the charge should've merged into the murder conviction for the purpose of sentencing because it did not require any proof of fact beyond what was required to prove malice murder.
