A Henderson County judge ruled Tuesday there was enough evidence to send a case against a man believed to have a video of Holly Bobo to the grand jury.
Sandra King testified at Tuesday's preliminary hearing that Jeffrey Pearcy showed her a video in which Bobo was tied up and crying.
"I seen a woman that was tied up that was crying," Sandra King said.
"Did you recognize the woman?" someone asked King in court.
"She was blonde. Yes, it looked like Holly Bobo," King added.
Bobo disappeared from her Darden, TN, home in April of 2011.
King testified that Zachary Adams, who has been charged with murder and kidnapping in connection with Bobo's disappearance, was also in the video.
"I knew what he was fixing to do; I did not want to see," King said.
Jeffrey Pearcy and his brother, Mark Pearcy, are charged with tampering with evidence and accessory after the fact in Bobo's murder.
King testified that Jeffrey Pearcy showed her the video that Mark Pearcy took of Adams having sex with Bobo. She said Bobo was tied up and crying.
So far, nobody else has seen the video, including investigators. So they set Jeffrey Pearcy up with a phone call.
"I said to him, 'You know that video of Holly, if it would have been you in that video, I would have watched it,' and he said, 'Yes I know,'" King said.
Jeffrey Pearcy said he couldn't hear what King was saying over the phone.
"I could barely understand her. I drive an old car with no air conditioner and I'm driving 60 mph, four windows down, and you've got people here prompting her to ask this question and prompt that question. I mean, I had no idea," he said.
Jeffrey Pearcy said he has not seen the sex video.
"You can't be convicted for something you haven't done," he said.
He said he believes King is mistaken and that it's a sex tape with Mark Pearcy and his ex-wife, who also happens to be named Holly.
"If that was his wife, then he's not much of a man by tying her up and making her cry and letting some other man have sex with her," King said.
The Bobo family and their friends were in court on Tuesday.
"I know that they're preparing Karen (Bobo's mother) and the family, and they're preparing us. We'll take one day at a time until we can get the justice that we want," said Tammy White, who is a friend of the family.
A TBI investigator testified they have a phone belonging to Mark Pearcy and are trying to unlock it to see if it contains the video. TBI agents have not seen the video.
Adams and Jason Autry have been charged in Decatur County with the kidnapping and murder of Bobo, although her body has not been found.
