Poulan mayor remains in office


The Mayor of Poulan can stay in office has he tries to put a prescription pain pill arrest behind him.

41-year-old Dustin Grubbs was indicted for possession of a controlled substance with intent to distribute.     

Albany Dougherty Drug agents arrested him during a traffic stop on Highway 82 in September 2012 with 57 prescription pain pills in a plastic bag, and not in their original container.     

Grubbs pleaded no contest under the first offender statute, and was given three-years probation.  

"The court has always ruled that that does not disqualify you from holding public office, because you plead under the first offender statute. It was ultimately no finding of guilt and so the person is entitled to continue in the public office they're in," said Poulan City Attorney Tommy Coleman.   

Coleman says he met with the city council to explain the legalities.
