ALBANY, GA (WALB) -

One person was killed around 5:30 Monday at the corner of Mock Road and Walter Brown on Albany's eastside, but it was not a hit and run, which WALB incorrectly reported this morning.

Albany Police say the driver, 42-year old Wesley Alvis, stopped at the scene where the pedestrian, 52-year old Johnny Burns was hit on South Mock Road.

Alvis was driving a Chevy Silverado and will not be charged in Burns' death.

Burns was walking North on South Mock Road in the central turn lane when Alvis was traveling North. Alvis steered into the turn lane and did not see Burns, and struck him. Burns died from his injuries. 

The finding of this investigation is that the pedestrian was walking in the middle of the roadway, wearing dark clothes, in an area that was not well lit.

 No charges will be filed.
