DECATUR, AL (WAFF) -

A grand jury will decide whether to file charges against a homeowner or the man he shot.

Investigators said Jason Brown and his sister, Joy McClimans, called police after her ex-husband showed up at a home on 7th Avenue Southwest in Decatur earlier this week.

They said Joy's ex, Gary McClimans, was harassing her, and after police left, Gary went back and kicked his way into the house. Police said Brown shot him twice in the chest.

Gary McClimans is still in ICU at Huntsville Hospital. Police said he seems to be recovering well.
