ALBANY, GA (WALB) -

It's just a matter of time before 40 year-old Brian Brannen is presented with a termination notice from the Dougherty County School system.

Brannen is charged with 10 counts of sexual exploitation of a child, and more charges are pending.

"When you terminate a teacher, you've got to tell them exactly why, said Dougherty County Schools attorney Tommy Coleman. "You've got to put the grounds for the termination in the notice to make it legal."

A hearing must be held within 10 days of that notice. But school officials can't hold a hearing for Brannen until he's out of jail.

"Once he gets out however, it's the systems intention to give him notice that he is being terminated and then we'll set a hearing date at that time," said Coleman.

Brannen, who taught 8th grade history at Radium Springs Middle School, was arrested Friday. Investigators say they found child porn on his computer. It has been sent away for a forensic examination.

"There's not a patient bone in my body when something comes to this. No mercy," said Superintendent David Mosely.

"A school system like ours is large. You're going to have some really good people and your going to have some really bad people," said Coleman. "They get hired and slip through. Frankly this guy was already on the list to be non-renewed, which means be terminated."

Authorities are still investigating whether any students are involved in the porn found on Brannen's computer.

He had an attorney before the incident because the school system sought to terminate him at the end of the year for disciplinary reasons.

At this time, it's unclear who his attorney will be in this case.
