On March 2nd, 2014, New Mexico became the 42nd state to enact a ban on texting while driving. The law, which goes into effect on July 1st, received broad bi-partisan support in the legislature, was quickly signed by the governor and was applauded by U.S. Transportation Secretary Anthony Foxx. Another proponent of the new law is Injury Attorney, Andras Szantho of the Szantho Law Firm, who hopes the new ban will reduce the number of distracted driving accidents in the state.

“By enacting no texting while driving legislation the state has given law enforcement a valuable tool in preventing accidents,” says injury attorney Andras Szantho, founder of the Szantho Law Firm. “Officers can now cite a person for using a handheld device, and we hope that as it is implemented we’ll see a reduction in the rates of collisions due to distracted driving.”

Distracted driving has been a major source of accidents in New Mexico for several years. It was directly cited in 24% of all accidents in 2011, making it the single largest contributing factor in collisions according to the 2011 New Mexico Traffic Crash Annual Report, the most recent year for which the report is available.

“Sadly it still needs to be stated that the only activity you should be doing while driving, is driving,” concludes Szantho. “When you focus on other things, it reduces your ability to react quickly to changing road conditions. This new law is a reminder of that.”
