Testimony underway in 2013 New Year’s Day murder trial

COLUMBUS, GA (WTVM) -

The trial for two men accused of killing a Columbus State University student is now underway.

Dequandrea Truitt and Shaquille Porter are charged with killing Charles Foster at the Majestic Sports Bar early New Year's morning 2013. 

Prosecutors said in opening arguments on Tuesday Feb. 18 that as the crowd rang in the new year, the defendants opened fire, killing Foster. However, defense lawyers argue police arrested the wrong men.

"…And when the smoke cleared, Charles Foster Jr. was dead and instead of planning a graduation party, his mother is planning her son's funeral," said LaRae Dixon Moore, Assistant District Attorney.

Defense attorneys also argued that witnesses are not credible and none, according to the defense, gave statements that they saw the defendants with guns in the club.

The state also played 911 tapes of calls being made from the bar in court.

There was more emotionaltestimony on Thursday Feb. 20.

Throughout the trial mostwitnesses have testified they did not know or see co-defendant Shaquille Porterthe night of the shooting.   

However, the onewitness implicating Porter took the stand with much apprehension.

The 26-year-old womantestified after she heard the first shot, she dropped to the floor but lookedup just in time to see Porter unload a hail of gunfire into the crowd. 

Erica Streeter is thesister of one of the people shot that night.

Streeter says she was notintoxicated that night but other witness testified seeing her with marijuanaand alcohol.
