Father, stepmother indicted in Gwinnett County child's death

GWINNETT COUNTY, GA (CBS46) -

A Gwinnett County grand jury has indicted a 10-year-old girl's father and stepmother after she was found dead in a trash can in November 2013.

Eman and Tiffany Moss were indicted on Wednesday on charges of murder, felony murder, cruelty to children and concealing a death in the death of Emani Moss.

The district attorney's office will pursue the death penalty against the couple.

The child was found on Nov. 2, severely burned, a result of her family trying to conceal the body.

Investigators believe Emani starved to death.

There were red flags of abuse against Emani Moss going back at least three years, prior to her passing.

CBS Atlanta obtained documents showing that the Department of Family and Children Services investigated at least six complaints about the family.

Several cases were closed after DFCS claimed they found no evidence to support the complaints.

Robin Moss, Emani's grandmother, said she intends to sue the state, claiming the state was negligent in protecting the child.
