The trial date is set for a man accused of stabbing a mother and her two young daughters to death in 2012.
Prosecutors said they are seeking the death penalty for David Brown, 36, when he goes to trial September 29. He faces the following charges:
First-degree murder (3 counts)
Jacquelin Nieves, 29; Gabriella Nieves, 7; and Izabella Nieves, 20 months, were found dead in their apartment on Nov. 4, 2012.
Firefighters found them when they responded to a fire there. Deputies said the fire was intentionally set to cover up the murders.
Investigators believe Brown broke into the Lockport apartment early that Sunday morning armed with a knife. They suspect he went into one of the bedrooms and sexually assaulted two of the victims before stabbing all three of them several times each.
According to deputies, Brown set the apartment on fire and left. The woman's husband, Carlos Nieves, Jr., was asleep downstairs the whole time. He eventually woke up and called 911 because the apartment was on fire. Detectives said Brown faces the attempted murder charge because the man was inside the apartment when the fire started.
Detectives said they found what they thought was the knife used in the attack on the victims and DNA at the scene that was matched to Brown.
