Defense plans to call everyone involved in 'Cell Phone Murder' trial

HUNTSVILLE, AL (WAFF) -

A Madison County Death Row inmate is expected back in court Wednesday. Day two of Nick Acklin's hearing for a new trial concluded Tuesday afternoon.

His new defense attorneys argue that the infamous ‘Cell Phone Murders' killer should get a new trial because he was on medication during his original trial more than 15 years ago.

Tuesday, prominent defense attorney Mark McDaniel took the stand, answering questions for nearly half an hour. He helped Acklin's defense team during jury selection, working pro bono.

The defense plans on calling nearly every person involved in the case, no matter how big or small a role they played. Acklin's two original attorneys have already been to the stand.

Questions arose on why the jury was never alerted that Acklin was on Xanax during his original trial. The defense also questioned how much effort Acklin's original attorneys put into his defense because they received a fraction of the $25,000 they were owed.

Day three of the trial begins Wednesday at 9 a.m. Officials said because of the number of witnesses that could be called to the stand, the hearing could last through the end of the week.
