ASU wins "whistleblower" lawsuit

ALBANY, GA (WALB) -

The Georgia Court of Appeals throws out a lawsuit against Albany State University.

Cassandra Smith, a former Associate Vice President, claimed she was wrongfully fired because she complained that the university wasn't following guidelines for federal grants.

The Court issued a summary judgement in the university's favor, ruling there was no basis to take the lawsuit to trial.

ASU Counsel Nyota Tucker said, "We feel that we've been vindicated. We believed that the Court of Appeals would rule in favor of the University, and it's satisfying that the Court ruled as a matter of law that the plaintiff had not prevailed on any of the claims she had made against the university."

University leaders say they had not been happy with Smith's job performance for a while, and when she told President Everette Freeman she could no longer work under her direct supervisor, he fired her. The Appeals Court ruled she was an at-will employee, and ASU had a legal right to fire her.
