The Supreme Court of Georgia Rules in south Georgia cases

ATLANTA, GA (WALB) -

The Supreme Court of Georgia has thrown out a Turner County court order in a dispute between the governments of Turner County and three cities over how Local Option Sales Tax proceeds should be distributed.

 Also, the Supreme Court of Georgia has upheld a Georgia Court of Appeals decision and ruled that the case of a new mother who sued a nurse midwife for medical malpractice must be retried.   While a Lowndes County jury had ruled in favor of the nurse midwife, the Georgia Court of Appeals reversed the ruling, finding that the obstetrician who testified on her behalf was not qualified as an expert witness under Georgia's expert witness statute.

 The Supreme Court of Georgia has upheld part of a Georgia Court of Appeals decision and ruled that under state law, a group of optometrists may continue to use their own inventory of lenses and frames to provide eyeglasses, rather than being required to purchase the materials from the company that insures them.  The optometrists had sued the insurer, Spectera, Inc., in Lowndes County Superior Court for suddenly requiring them to obtain eyeglasses and contact lenses from the company's optical laboratory rather than from their own lab.

 In other cases, the Supreme Court of Georgia has upheld murder convictions and life prison sentences for Tony Williams.
