ALBANY, GA (WALB) -

Testimony is scheduled to resume in the morning in the trial of a man charged with murdering a 3-year old child.

Testimony began Tuesday after the jury of 9-women and 5-men was seated.

26-year old Rico Jones is charged with felony murder in the December 26, 2010 death of Camyria Arnold, his girlfriend's daughter.

In opening statements Prosecutors said the child died from "total criminal negligence" by Jones who was caring for the girl while her mother worked.

Prosecutors say the child died from dry drowning, similar to water boarding.  And that she had marijuana in her system because Jones smoked around her.

His attorney told the jury Jones put girl in the shower when she appeared dazed and ill, then took her to the hospital.

She died two days later.
