Inmate awarded $45,000

A jury awards a convicted killer tens of thousands of dollars after officers at a south Georgia prison beat him.  

Ammon Sumrall is serving a life sentence at Autry State Prison in Mitchell County for a Dekalb County robbery and murder.  

He says he suffered cracked ribs and a back injury when a Correctional Emergency Response Team at the prison beat him in 2009.  

A jury agreed and awarded him $45,000 in damages. His attorney acknowledges officers sometimes must use force, but he says they went way overboard in this case.  

"Law enforcement officers have a really tough job and they have to use force in their job when it comes to protecting other people but what the US constitution prevents is the use by law enforcement of excessive force and this was a case of excessive force,"said Charlie Peeler, Sumrall's attorney.  

The jury ruled the officers "acted with malice" in their treatment of Sumrall and that their actions violated his constitutional protection from cruel and unusual punishment.
