Tracey Smith was found guilty of felony murder, and will be sentenced Monday. He was convicted of Jerome Walden with a board in 2011.
Prosecutors say 35 year old Tracy Smith and two other men chased 45-year old Jerome Walden into an alley on Edgerly Avenue June 24th, 2011 and beat him with a board with nails in it.
Walden died that August.
In December 2011, a jury convicted Smith of aggravated assault and battery but deadlocked on the murder charge.
"He did not deserve what they gave him. Today I can stand before you and say that me and my family have some kind of peace of mind because justice was served for him today," said his niece Wanda Rivers.
The State Supreme Court okayed his re-trial, rejecting his appeal that it would deny him double jeopardy protection.
