ALBANY, GA (WALB) -

The jury is now deliberating in the murder trial of an Albany man charged with beating a man to death with a board,  in Dougherty Superior Court.

Prosecutors say 35 year old Tracy Smith and two other men chased 45-year old Jerome Walden into an alley on Edgerly Avenue June 24th, 2011 and beat him with a board with nails in it.

Walden died that August.

In December 2011, a jury convicted Smith of aggravated assault and battery but deadlocked on the murder charge.

The State Supreme Court okayed his re-trial, rejecting his appeal that it would deny him double jeopardy protection.

Prosecutors expect this re-trial to continue the rest of the week.
