Jury selection continued Tuesday in the murder re-trial of an Albany man, charged with beating a man to death with a board.
35-year old Tracy Smith's felony murder trial started Monday.
Prosecutors say he and two other men chased 45-year old Jerome Walden into an alley on Edgerly Avenue June 24th, 2011 and beat him with a board with nails in it.
Walden died that August.
In December 2011 a jury convicted Smith of aggravated assault and battery but deadlocked on the murder charge.
The State Supreme Court okayed his re-trial, rejecting his appeal that it would deny him double jeopardy protection.
