ALBANY, GA (WALB) -
An Albany man files a multi-million dollar federal lawsuit against an Albany Police officer, saying he was jailed for 16 months even though the officer knew he was innocent.
This is Richard Hayes mug shot, when he was arrested in September 2009 and charged with aggravated assault and gang participation when he was 17-years old.
In his suit against Albany Police Officer Charles Flowers, Hayes says he was unjustly held in the Dougherty County jail for the next year and four months. In March 2011 the charges against Hayes were dropped.
"When you talk about taking away somebody's freedom for a couple of hours it's one thing," said Hayes' attorney James Finkelstein. But for a year and four months when they were 17 years old. To spend those months in jail locked up for a crime he didn't commit, that's a terrible injustice."
In his lawsuit, Hayes asks for a jury trial. He's seeking more than two million dollars in general and punitive damages. Albany City Attorney Nathan Davis said they will vigorously defend against the lawsuit, and said the suit was without merit.
