In a 5-to-2 decision, the Supreme Court of Georgia today has denied a stay of execution for Warren Lee Hill. 


Hill, 53, is scheduled to be put to death tonight at 7:00 p.m. by lethal injection at the Georgia Diagnostic and Classification Prison in Jackson, GA. In addition to denying Hill's Motion for Stay of Execution, the Court also has denied his application to appeal a decision by the Butts County Superior Court dismissing his claim that he's mentally retarded.

Hill was given the death sentence in 1991 after a Lee County jury convicted him of murder in the 1990 bludgeoning death of a fellow prison inmate, Joseph Handspike.

 At the time, Hill was serving a life prison sentence for the 1986 shooting death of his 18-year-old girlfriend, Myra Sylvia Wright. 

All the justices concurred in today's decision except Chief Justice Carol Hunstein and Justice Robert Benham, who dissented.
