Wrong suspects nabbed in Merry Acres shooting

It was the night of November 23rd when surveillance cameras at Merry Acres motel captured two men believed to be the suspects in a botched robbery turned shooting.

Less than a week later, arrests were made.

"We thought they had caught the right guys but in further investigation. I believe they've learned some new information," said Merry Acres' owner Bo Henry.

Henry learned Tuesday the new information was that police had arrested the wrong guys.

We obtained a warrant dismissal from APD which states that 21-year-old Sydney Kerlegon and 18-year-old Travin Bryant had the charges against them dropped.

Kerelgon remains in jail on unrelated charges. Bryant was released.

Detectives were working on a tip when they raided Kerlegon's Seedling Drive home November 26th and an seized a 12-gauge shotgun.

It was believed, at the time, the weapon was used to shoot 41-year-old Thomas Bennett.

He was in town for Thanksgiving when police say two men tried to rob him while he went to get ice. He locked himself in a foyer but was shot through the window.

Henry says the crime led to major security changes.

"We have 24 hour security, of course. We have police security at night now. We put in more cameras and more lights. We're trying to do everything we can to make this a very safe place," said Henry.

Police officials would not go on camera, but in a press release say the shooting, along with several armed robberies remain under investigation with arrests pending.

"By all means we don't want the wrong ones locked up, we want the right ones locked up. We hope in the near future that's who will be there," Henry said.

Following that shooting Henry put up a $5,000 reward leading to an arrest and conviction. He says that money is still being offered for whomever has the right information.

The victim, Thomas Bennett, was shot in the back and released from the hospital.

Anyone with information is asked to call Albany Police.
