ALBANY, GA (WALB) -

We are learning more about who was in the car that officials say Corporal Patrick Browner rear-ended.

This is the intersection where Corporal Patrick Browner rear-ended a Honda Civic, driven by 39 year-old Roderic Baker. 5 year-old Trenton Hall was also in the car.

State troopers say Browner was off duty and driving his patrol car west on Dawson Road around 12 a.m. Thursday, when he hit the Civic, which was stopped at a red light at the intersection of Pointe North.

The trooper who worked the crash believed that Browner was under the influence, but we may never know of what.

"He refused any tests or any type of field sobriety tests to determine whether he was under any influence of any alcohol or drugs," said GSP Post 40 Commander Sgt. Shawn Urquhart.

It appears a toxicology report was never done. GSP says Browner refused all testing. He has been charged with DUI refusal and following too closely.

"The report is not finished yet. But the trooper detected either alcohol or drugs. So the APD officer was taken down to the Dougherty County Jail," explained Urquhart.

APD is now conducting its own internal investigation. Browner is suspended without pay until that investigation is complete.

State troopers say Browner's license may be suspended. He has been given a temporary permit for 30 days and he has ten days to request a hearing.  If that's not done, his license will be suspended.

Officials say Baker was taken to Phoebe North, but released a short time later. It appears that the child was not injured.

Troopers say Browner's been with APD at least ten years.

Albany Police officer Corporal Patrick Browner spent Thanksgiving morning in Dougherty County jail after rear-ending a Honda Civic in his patrol cruiser on Dawson Road and Point North Road, while he was off-Duty, around midnight Thursday.

After investigating, troopers determined that Browner was under the influence of some substance.

Browner refused a breathalyzer test so troopers do not know whether he was under the influence of alcohol or another drug.

"He (the trooper) saw an indication that he might have been under the influence of some type substance, whether it's alcohol or drugs, and the officer refused the test. My trooper did what he had to do and charged him with DUI refusal," said GSP Post 40 Commander Sgt. Shawn Urquhart.

APD released a statement Thursday evening after we broke the news saying, "based on the charges, Browner has been placed on suspension without pay and Police Chief John Procter requested that an internal investigation be conducted immediately. He will remain on suspension without pay until the conclusion of the investigation."

With more than 43 million people expected to be on the road this holiday, Sgt. Urquhart stresses all drivers should use better judgment while behind the wheel.

"People need to be safe this weekend. Everybody included. If you're drinking please don't get behind the wheel because it can be an innocent person that gets hurt in the process," said Sgt. Urquhart.

The fate of Browner's future with the force remains in question Thursday evening.

The Driver of that Honda Civic was taken to Phoebe North. We were told he is ok and he was discharged a short time after.

Browner faces charges of DUI refusal and following too closely.
