Six members of the troubled Sumter County School Board want a judge to prevent the State Board of Education from kicking them out of office.
The State Board is supposed to meet Wednesday to decide whether to recommend that the Governor remove the local board members because the system is in danger of losing its accreditation.
Six of the nine Sumter Board members are suing the state challenging the law that gives the Governor that power.
They're also asking for an injunction to postpone next week's state board meeting.
They say a mediator is scheduled to meet with the board in two weeks to help them work through their problems.
"Unfortunately, one person has the ability as it stands right now to say I don't want to mediate and because I don't want to mediate I want the whole system taken down and I think that's immoral," said the plaintiff's attorney Brian Watkins.
We talked to board member Michael Busman by phone Friday evening.
He says he and the other two members who are not part of the suit didn't know anything about it.
He told us he was also unaware of any meeting scheduled with a mediator.
A hearing on the motion for an injunction to stop the state meeting is scheduled for Tuesday before a judge in Fulton County.
