ALBANY, GA (WALB) -

District Attorney Greg Edwards says he plans to go to the Grand Jury for a murder  indictment against an Albany woman, after a Magistrate Judge dismissed them.

24 year old Sade Britt had been charged with felony murder in the death of 52 year old Anthony Westbrook, whose nude body was found on a mattress in an illegal dump site in South Albany. He had been shot in the back of the head execution style.

Police say Britt, wore a mask, and was driving Westbrook's car and using his debit card at a downtown bank the night before his body was found.

On September 28th Magistrate Judge Robert Revell dismissed the murder charges after a committal hearing for a lack of evidence.

D. A. Greg Edwards says he will ask the Grand Jury for a murder indictment, while Britt's lawyer says there is no evidence.

"Even if there are persons further involved in this case, our intention is to show that part of this case regarding this defendant," Edwards said.

Britt's Attorney Roosevelt Carter II said, "I believe the police department relied on inmates in jail as far as their confidential sources, who lack credibility. And finally I believe the only reason she is charged with murder was she exercised her constitutional right to stay silent and her right to have counsel."

Britt remains in jail without bond on theft and stolen car charges. The D. A. says the investigation into Westbrook's murder continues.
