An Albany man fired at least 8 shots to scare thieves out of his car early Monday morning at a NorthWest Albany apartment complex, and police arrested him.

32-year old Rush Winford was charged with discharging a firearm in the city limits.

Winford told Police he was walking his dog at the Shoreham Apartments about 12:45 a-m, when he saw two men in his car.

He pulled his .45 pistol and fired several shots in the air as he chased them through the complex.

Officers recovered 8 shells.

The thieves got away.

Winford is an active duty member of the Army.

He was fined $225 dollars and released, but police kept his gun.

Winford sent us an e-mail saying he could have injured or killed the men but chose to fire warning shots after yelling at them.
