Lawyers for condemned killer Ray Johnson will be in court in Albany next week hoping to convince a judge to order new DNA tests on evidence in his case.

We've learned that hearing is now scheduled for August 15th.

Johnson was sentenced to death for the brutal 1994 rape and murder of Angela Sizemore.

Dougherty District Attorney Greg Edwards says the hearing will settle several issues such as what materials might be tested and the cost of testing.

"There are parameters and there has to be a reasonable basis for the need of the testing and that's where we're going to be trying to narrow things down and make sure that the courts order gives us clear direction and gives clear direction to the people doing the testing," said Edwards.

Dougherty Superior Court Judge Willie Lockette delayed Johnson's execution in October, one day before he was scheduled to be put to death.
