An Albany Police officer convicted of child molestation in 2010 will get a new trial. Thursday, the Georgia Court of Appeals upheld a lower court's ruling granting a new trial to Vincent Wadley
The appeals court agreed that trial Judge Denise Marshall made impermissible statements commenting on evidence in front of the jury.
Prosecutors say Wadley, a former Corporal in the APD Investigations division molested a 7-year old girl in May 2008.
The court of appeals says a retrial is appropriate.
