Convicted robber heads to court again

Michael Phillips and his half brother were convicted of armed robbery and aggravated assault in 2005 for terrorizing the quiet Lake Park neighborhood. But now Phillips will get a new trial.

Police say Silas Jackson and Michael Phillips committed two armed robberies outside homes in the Lake Park Neighborhood. They robbed one family getting out of their car and a few minutes later saw the opportunity to rob another family.

Jackson was sentenced to 45 years in prison and Phillips was sentenced to life without parole, because he had prior felonies.

Because he had two armed robbery convictions the most that he could receive is two life sentences and because of the recidivism they must be without parole but next week, he could walk free.

The Georgia Court appeals has granted Phillips a new trial because the defense did not get vital information that could have helped their case. That evidence was a witness statement taken by police that was misfiled and no one knew it existed.

Residents say they still hope Phillips gets what he deserves.

District Attorney, Greg Edwards is confident prosecutors will prove their case a second time. Nothing about the prior trial will have any effect on the new trial.  Jury selection begins on Monday.
