ALBANY, GA (WALB) -

Lawyers for Phoebe Putney Health System are already preparing to argue their case for the buyout of Palmyra Medical Center before the U-S Supreme Court.

They anticipate the case will come before the Supreme Court in early November, but they must prepare now to file briefs.

Monday the high court agreed to hear the Federal Trade Commission's appeal of a lower court ruling that allowed the merger to go through.

Until then Phoebe will continue to manage the hospital as Phoebe North.

"That hospital will be Phoebe North, and continue right on in it's operation', said Phoebe Putney Senior Vice President Tommy Chambless.  "We're doing a lot of things to improve health care in this area, of the consolidation of matters for the efficiency of our community. We're just going to continue that game plan."

Phoebe officials refuse to speculate what would happen if the Supreme Court rules against them and blocks the purchase.

Seth Waxman,  a former Solicitor General of the United States, will serve as lead legal counsel for Phoebe before the Supreme Court.
