Mother testifies against daughters in trial

An Albany woman testified for a second day in the trial of her daughters who are accused of maliciously having her confined to a mental facility.

The defense attorney asked for a mistrial today because of her testimony.

Prosecutors say Carrie Franklin and Connie Justice illegally had their mother committed to the mental ward at Phoebe Putney Hospital in September after she filed criminal charges to have them evicted from her house.

Jean Sancken was ordered not to mention her daughter's criminal history in her testimony.

She did refer to it during her second day of cross examination.

Judge Denise Marshall denied the mistrial motion but admonished Sancken to limit her answers.
