Mother confinement trial begins

The lawyer for two Albany sisters told a jury they had been concerned about their mother's mental state and alcoholism for months, before having her confined into a mental facility in September 2011.

Prosecutors say the sisters had their mother, Jean Sancken, confined because she was throwing them and their families out of her house.

The trial for Carrie Franklin and Connie Justice began today. The two sisters are charged with malicious confinement of a sane person and false swearing.

Chief Magistrate Judge Baxter Howell was the first witness called by prosecutors. Sancken went to Judge Howell to get a criminal trespass notice against the sisters and their families to force them out of her home.

Prosecutors say the sisters then filed court papers saying their mother was insane, an alcoholic, and a danger to the community, having her committed to the mental ward at Phoebe Putney.
