A former Albany Police Officer, convicted of child molestation in May 2010, will get a new trial.
Judge Stephen Goss signed an order granting a new trial for 47-year-old Vincent Wadley.
The ruling is based on impermissible statements made by the trial judge Denise Marshall.
Prosecutors say Wadley, a former Corporal in the APD Investigations division, committed a sex act with a 7-year-old girl in May 2008.
Wadley's new trial is September 26th. He is ordered held in jail without bond, because he is a flight risk.
