Investigators believe robbery was the motive behind Barbre's murder.

Barney is currently out of on bond.

The Dougherty District Attorney doesn't plan to prosecute a suspect in a mysterious 3 year old murder case, but he isn't closing the case either.  The D-A is placing the case on the dead docket.

Marquis Barney was indicted for murder and aggravated assault in May 2008.

Prosecutors think he hit 52-year old John Barbre in the head with an unknown object near the Tallulah Massey Library.

Barbre died two days later.

In his motion to dead docket the case, D-A Greg Edwards said prosecutors don't have enough evidence to win a conviction right now.  But the investigation continues.

Dougherty D.A. Greg Edwards said "Placing it on the dead docket pretty much puts it on hold. And at some point if there are additional things brought out, the case can be represented to a trial."
