Albany murder charge dead docketed

Investigators believe robbery was the motive behind Barbre's murder.

Barney is currently out of on bond.

The Dougherty District Attorney doesn't plan to prosecute a suspect in a mysterious 3 year old murder case, but he isn't closing the case either.  The D-A is placing the case on the dead docket.

Marquis Barney was indicted for murder and aggravated assault in May 2008.

Prosecutors think he hit 52-year old John Barbre in the head with an unknown object near the Tallulah Massey Library.

Barbre died two days later.

In his motion to dead docket the case, D-A Greg Edwards said prosecutors don't have enough evidence to win a conviction right now.  But the investigation continues.
