ALBANY, GA (WALB) – Dontavius Thomas had other run-ins with the law. He previously broke into the same store police say he robbed last night.
Thomas broke into the Pitt Stop in June of last year and stole more than 15-cartons of cigarettes.
He pleaded guilty as a first offender and was placed on felony probation.
Dougherty District Attorney Greg Edwards isn't sure yet whether he'll seek the death penalty, put he says all the requirements are there to make this a capital case.
"We're at the tip of this investigation but at present the statutory circumstances are there. We have aggravating circumstances that could be the basis for a death penalty prosecution," said Greg Edwards, Dougherty Co. District Attorney.
Police believe Thomas is from the Albany area but may be homeless.
