ALBANY, GA (WALB) - A 2002 Lee County case was the key as the Georgia Supreme Court writes new standards to define the crime of kidnapping.
Justices reversed the kidnapping conviction of Joey Garza, who was convicted in 2002. Prosecutors say Garza tied up his girlfriend at her home, and moved her son from one room to another. He was found guilty of kidnapping, saying he moved the boy from one room to another.
Justices say prosecutors overstepped the law to define that as kidnapping.
