Goddard appeals dismissal

ALBANY, GA (WALB) - The attorney for the fired Civic Center director says a judge dismissed the case before reviewing all the evidence.

Maurice King, the attorney for fired Civic Center director Mattie Goddard says Superior Court Judge Ronnie Joe Lane didn't even look at Goddard's deposition and other sealed files before he threw out the lawsuit.

King has appealed the case to the Court of Appeals. He says Goddard had a fundamental right for the judge to review all the evidence before he dismissed the case.

Goddard sued the city of Albany in 2006 after she was fired. She claimed she was discriminated because of her race, gender and age. A federal lawsuit was dismissed earlier this year. That is also under appeal.

City Manager Alfred Lott says he feels confident the city acted correctly and will prevail.  "I expect that we'll prevail in any appeals or anything else association with this particular case. I have no intention of backing down in this case. I feel that we did the right thing."
