ALBANY, GA (WALB) - Nineteen-year old Charlie Henderson III was shot early Tuesday morning outside the Quality Inn/Merry Acres motel, which is next door to the Comfort Suites.

Witnesses told police they saw Henderson going car to car in that motel parking lot trying to open doors. One of the witnesses, 20-year-old John Underwood of Tallahassee, shot Henderson. Underwood was subsequently charged with aggravated assault and released from jail Wednesday.

It was just 13 days ago that Charlie Henderson III stood before a judge and pleaded guilty to misdemeanor gun charges.

He was arrested in May at Willowood Apartments for having a 9 millimeter pistol stuck in his pants waistband.

July 18, on his 19th birthday, Henderson pleaded guilty and was sentenced to 24 months probation.

He remains hospitalized with a bullet wound and police haven't decided whether he'll be charged in this case.
