ALBANY, GA (WALB) - A suspected thief remains hospitalized after being gunned down at an Albany motel.  Police believe the 19-year-old man was breaking into cars at the Comfort Suites on Dawson Road.     

Twenty-year-old John Underwood of Tallahassee, Florida is the one who shot him, and he's charged with aggravated assault.     

Police say Underwood and some co-workers were staying at the Comfort Suites when they spotted 19-year-old Charlie Henderson tampering with cars in the parking lot.      Underwood flagged down police and while police cruised the area, Underwood and his friends spotted Henderson getting into a car to leave. 

Underwood fired three shots, hitting Henderson was shot at least once in the arm.

"He did tell police that he did commit the shooting and he turned over his weapon," said Albany Police Media Manager Phyllis Banks.         

Police heard the gunshots. Their reports indicate Henderson was wearing all black and had white gloves next to his car and a screwdriver on the driver's seat.   He is in fair condition at a hospital.  

Underwood remains in jail and will appear before a judge Thursday morning.
