 Okaloosa County, FL --  Thirty-three-year-old Eugene Smith was arrested in Santa Rosa County, near the spot where the deputy's car was abandoned.

A Crisp County deputy stopped there for a bathroom break as he transported Smith back from Texas.

Somehow Smith was able to spray the officer with pepper spray, and things got really dangerous.  

Smith took off on Highway 90 into Santa Rosa County. Officers launched an all-out search. Before dark, they found the patrol car. He was arrested about 10:45 today.

Officers say he is a man, but is a transvestite and looks like a woman. He faced identity theft and fraud charges in Crisp County and obviously will be charged with numerous other crimes now.

Crisp County Sheriff Donnie Haralson would not identify the deputy, but he told us that he will investigate to determine whether the officer violated protocol.
