District Attorney declines charges

Albany -- No criminal charges will be filed against the driver of a pick up truck who accidentally accelerated through the Burger King drive thru, striking and killing a Shellman woman on December 6, 2007.

Friday District Attorney Ken Hodges said to charge 78-year-old driver Raymond Williams of Smithville, Williams would have had to have been operating the vehicle under the influence or in a reckless manner. Hodges says that wasn't the case.

Roseanna Eubanks was killed and her twin sister Rebecca Todd and Eubanks four year old daughter Emily were injured when Williams sped towards them. Williams claimed his gas pedal stuck.
