Albany- Timothy Murray, the 19 year old shot and killed yesterday, was arrested after a gang roundup in Albany in July.
Just two months ago, a jury found him not guilty of aggravated assault in the February gang shooting of James Hall. The District Attorney's office believes jurors are often intimidated of possible retaliation in gang cases and won't convict because of witness credibility.
"A lot of times the cases involve other gang members serving as witnesses and of course there is automatically some consideration about the credibility of the witnesses that are testifying," said Greg Edwards, Assistant District Attorney.
During that trial prosecutors accused Murray of being a member of the Crips street gang. Murray's father insists his son is not a member of the Crips.
