Albany --  A well known Albany restaurant owner was arrested again after he flunked a drug test.

Five months ago, Johnny Gargano, the owner of Villa Gargano in Albany, pleaded guilty to possession of methamphetamine. He got six months probation. As part of that probation, he has to submit to drug tests and Monday, he tested positive for marijuana use.

He was arrested and booked on probation violation charges and is again back out of jail.

Gargano's attorney says the test gave a false positive.
