Moultrie-  It's now up to a District Attorney to decide whether to file charges in a fatal police shooting in Moultrie.

The Georgia Bureau of Investigation has turned its report over to District Attorney David Miller in the shooting death of Willie Banks. Banks was shot by a Moultrie police officer November 16th who said Banks came at him with a knife.

Miller says, he volunteered to share the information in the GBI report with Willie Bank's family and offered to show them the store's surveillance tape but they declined.

Moultrie Police Sergeant Bruce Hamm was trying to serve a warrant on Banks when the shooting happened. The District Attorney is expected to make a decision next week.
