Albany -- A Dougherty County jury returned a not guilty verdict on all eight counts of murder and aggravated assault.

  Albert Smith was accused of shooting Xavier Hines behind the House of Jazz in 2003. Prosecutors say it stemmed from a drug deal.

Four days of testimony wrapped up Thursday afternoon. Smith's attorney claims the prosecution did not prove Smith was the shooter and left too many questions to find him guilty. The jury deliberated for about an hour Thursday, before continuing their deliberations Friday.

Two other men indicted in this murder case testified that Smith was the shooter.  Charges against those two were dropped for their testimony. Broderick Wilcox was found guilty of masterminding the murder last year and sentenced to life in prison.

Albert Smith is now headed back to federal prison in Florida to finish serving ten years for other drug and robbery charges.
